Constitutional courts decides retrial of police who killed Ali İsmail Korkmaz

ANKARA- The Constitutional Court accepted the application of Ali İsmail Korkmaz's family, who was killed during the Gezi demonstrations, for "violation of the law of prevention of torture", decided to pay compensation and to retry the police officer Hüseyin Ergin.
 
The decision of the Constitutional Court (AYM) regarding the application of the family of Ali İsmail Korkmaz who was beaten to death by the police with some civilians in a street in Eskişehir during the Gezi demonstrations in 2013. Ali İsmail Korkmaz's parents and his siblings applied to the AYM on the grounds that an effective investigation was not carried out, the events unfold during and after his death and the manner of his death, the suffering caused to his family and the violation of the right to organise an assembly or a demonstration.
 
The court rejected that the right to life of Ali İsmail Korkmaz was violated, the the right to organise was violated, the law of prevention of torture was violated, however the court accepted that the relatives of Ali İsmail Korkmaz suffered from his death and the 17th Article of the Constitution which guarantees the material and procedural aspects of the prevention of torture was violated therefore decided that the familiy is paid compensation and the police officer Hüseyin Ergin to be tried again.
