Yıldırım who was accused of 'being a member of an illegal organization' and 'recruiting for an illegal organization' for attending HDP events with his wheel chair, was sentenced to 12 years by Mardin 2nd High Criminal Court. After the sentence was approved by the Supreme Court, Yıldırım was taken into custody with a raid on his home on 30 December 2018 and placed in Mardin E Type Closed Prison.

 

Forensic Medicine Institute's 3rd Specialization Board gave a report stating that he can not sustain his life alone. 

 

The prosecutor office then asked the Kızıltepe District Governorate and the District Police Department if Yıldırım is a danger for society. Both institutions presented their opinion and said 98 percent disabled Yıldırım was a danger for society and as a result, the prosecutor's office rejected his appeal to be released.

 

Serdar Yıldırım's older brother Sedat Yıldırım rebelled against the decision and said his brother has been detoriorating due to his detention and facing death and still being held in prison despite the ATK reports, said: "How can a 98 percent disabled person be a danger to the society from his bed? Does the prosecutor even read these reports or decide solely according to the opinion of a single police officer?"

 

Yıldırım also stated that his brother who can not sustain his life alone has been held in solitary confinement for the last 3 months. Yıldırım said: "They can give him house arrest. They would have figured something out if they wanted to. We demand his immediate release."
