AYM rejects appeal for Cizre basements where people were burned to death

ANKARA - The Constitutional Court (AYM) rejected the appeal regarding the people burned to death in the basements in Cizde during the curfews declared back in 2015.
 
The lawsuit filed at the Constitutional Court (AYM) regarding those who were killed in 2 separate basements during the curfew that was declared on December 14, 2015 and lasted 79 days in Cizre district of Şırnak was rejected by the court. The reasoned decision has not been published yet.
 
The reason for the application made to the Constitutional Court included the following: "The appeal was made for; The right to liberty and security of the person, the injuries caused by the unfair and disproportionate use of force by the security forces, keeping the injured in a wounded and exhausted condition until they die in the place where they are located, denial of access to health services, the impact on the mental state of the relatives of the aforementioned persons, the death of the wounded as a result, the inability of the relatives of the deceased to reach the bodies for a long time, the failure to conduct an effective criminal investigation into the mentioned events, the impunity for public officials who used force, and the abuse of human rights and freedoms by the state should be considered a violation of the bans on the right to ill-treatment and the abuse of fundamental rights and freedoms."
 
BACKGROUND
 
The curfew declared in Cizre district of Şırnak on December 14, 2015 lasted for 79 days and was lifted on March 2, 2016. During this period, 11 districts of the county with a population of 131 thousand were completely closed to entry and exit, again telephone, internet and electricity lines were cut off. Cudi, Nur, Sur and Yafes neighborhoods were hit with cannon fire with tanks placed in the high parts of the city. After the 20th day of the ban, nearly 110 thousand people had to migrate from the district.
 
288 PEOPLE KILLED
 
During the ban, many injured died because they could not be taken to the hospital and the ambulance did not go to the scenes. According to the reports of human rights organizations, 288 people died in the city.
 
177 PEOPLE WERE BURNED BY SOLDIERS IN TWO BASEMENTS
 
177 people were burned alive in the basements they took shelter in on February 7, 2016. The reports prepared included information that people who died in the basements were first killed with firearms and then their bodies were burned. There is no information about the whereabouts of the bodies of 14 people who lost their lives in these basements.
