Torture under custody considered 'duty defect' 2019-09-07 11:43:11 DİYARBAKIR- The 3 gendermerie who are reported to have tortured the villagers, were sued with the charge "violation of the authority to use force" instead of "torture and ill- treatment". Hani District Gendermerie COmmand teams who raided the village Upper Turalı after a police was killed in Diyarbakır, Hani; took Ali İhsan Abdulsemet, Ayhan and Tuncay Opçin under custody. The battery they were subjected to was reported with a medical report. However, even though the victims of tortured filed a criminal complaint with the accusation of torture, the file was suited for "violation of the authority to use force".     The 3 suspects who did not accept the charges was charged with "violation of the authority to use force" with a sentence request of 6 months to 1 year.   In the indictment prepared by Hani Public Prosecutor Yunus Küçükçakır,was accepted by Hani Criminal Court of First Instance and a date was given for the hearing.
