Former member of Venice Commission: ECHR did't come out of nowhere, it is withing the structure of our law 2018-11-27 10:53:09   İSTANBUL- Former member of Venice Commission Assoc. Prof. Dr Öykü Didem Aydın indicating that Turkey has to abide by the decision of ECHR, reminding the 148th article of the constitution, said: ECHR didn't come out of nowhere, it is within the structure of our law."    European Court of Human's Rights (ECHR) passed the verdict about the file of Former Co-chair of People's Democratic Party Selahattin Demirtaş on November 20 and said "Must be released immediately". Despite the verdict and the applications of the attorneys 19th Criminal Court did not take a concrete step concerning the subject. Former member of Venice Commission and Assistant Prof. Dr of Hacettepe University faculty of Law Öykü Didem Aydın who commented on the subject matter said: " In any public power intervention against fundamental rights, the ECtHR always pay attention to the circumstances of the concrete incident, its situation and the environment. When you look at the previous decisions, anyone whose fundamental rights intervened was evaluated if they are related to violence, hatred or terror."
