Nolle pros for strip search and violence in detention 2024-11-11 11:37:19 RIHA - A decision of “nolle pros” was made in the criminal complaint of 64-year-old Adle Samur, who was subjected to strip search and violence in detention.  The criminal complaint filed by Adle Samur (64), who was detained with her husband Mehmet Samur during a house raid on March 2, 2023 in Karacurun hamlet of Mishecerk (Gönen) quarter of Pirsûs district of Riha (Urfa), alleging that she was subjected to “torture and ill-treatment” and strip searches in Type T Prison No. 2. Suruç Public Prosecutor's Office decided “nolle pros” on Samur's criminal complaint against Urfa Security Directorate TEM Branch Directorate for “abuse of duty” and “torture and ill-treatment”, claiming that there was “no concrete evidence” without starting any work to collect evidence.    Samur's lawyer Ali Arslan, who appealed the decision, stated in his petition that the decision is against the procedure and the law, citing the European Court of Human Rights' (ECtHR) rulings on torture and ill-treatment. In his petition, Aslan emphasized that an effective investigation was not carried out and that the evidence was concrete, noting that the torture his client was subjected to was confirmed by the minutes kept after the incident and forensic examination reports. In his petition, Aslan demanded that the decision of nolle pros against the public officials involved in the crime be lifted and an effective investigation be carried out.    WHAT HAPPENED?    On February 24, 2023, 7 people were detained in Karacurun hamlet of Mishecerk (Gönen) quarter of Pirsûs district of Riha (Urfa) after a clash between soldiers and Sıtkı Kurtoğlu, who was identified as a PKK member. On March 2, 2023, Mehmet Samur and his wife Adle Samur were allegedly subjected to ill-treatment during the detention operation. Adle Samur, 63, stated that she was subjected to strip searches at Urfa Provincial Security Directorate TEM Branch and at Urfa Type T Prison No 2, where she was arrested and taken to. Adle Samur filed a criminal complaint against the officials.  Samur was released at the first hearing held at Urfa 5th High Criminal Court on September 23. Mehmet Samur is still under arrest.
