Beştaş: They will be the ones standing trial in Kobané Case 2021-04-22 10:38:21   ANKARA - Stating that the Kobané Case and the law suit to ban their party are an organized attempt, HDP Group Deputy Chair Meral Danış Beştaş told that the aim of these law suits is to prevent HDP and other opposition parties to unite.   The first hearing of the Kobanê Case will be held on April 26 at Ankara 22nd High Criminal Court. 108 people, 28 of whom are currently behind bars including the former Co-Chairs Selahattin Demirtaş and Figen Yüksedağ will be tried within the scope of the law suit. The hearing will be followed by a large group of lawyers and foreign delegations.   Meeting with a number of journalists including Mesopotamia Agency (MA) reporters before the meeting, Meral Danış Beştaş answered questions about the case.    A SPECIAL PROSECUTOR WAS APPOINTED FOR THE CASE   Beştaş stated that 8 prosecutors have changed so far in the Kobanê Case investigation and a special prosecutor was appointed for the case in 2018 and said, “This prosecutor is appointed to the İzmir Chief Public Prosecutor's Office in 2018. Then Selahattin Demirtaş becomes a presidential candidate. Somehow, after 2-3 months, this prosecutor returns and continues the proceedings from where he left off. After this prosecutor is assigned, a confidentiality order was given for the case and the investigation was expanded. The request for the famous second arrest warrant is also made by this prosecutor. Just the day after Erdogan said, "We will do our counter-move, we will finish the job.   'WE ARE ACCUSED OF KILLING OUR CONSTITUENTS'   Stating that the prosecutor of the case, who is known to be close to MHP started a hunt for witnesses, Beştaş continued: "“He sends letters to all prosecutors and wants evidence regarding Kobanê. But of course there is no such evidence. And he prepares this freak show of an indictment. This indictment is full of lies. There are no autopsy reports for 37 people. They cannot establish a causal link between Tweets and death. There is not one criminal element in the file. This prosecutor criminalized the defenses of Yüksekdağ and Demirtaş in the 19th High Criminal Court. Their answers to the questions of the judge and their statements were considered to be evidences for the crime. It is not a legal text. They didn't even investigated into the deaths of the people except for 2-3 of them. 43 people were killed according to the data we obtained. Most of those were our constituents. We are accused of killing our constituents."   'THEY WILL BE THE ONES TO STAND TRIAL'   Beştaş also stated that a special delegation was assigned for the trial. Beştaş stated that it was said that the delegation would hold a hearing every day and that they would adjourne for a maximum of 3-5 days, emphasizing that this was not humanly possible.   Beştaş said: "They want to accelerate the hearing to achieve their political goals.Our friends will make their defenses and say what they have to say, and present material evidences. Our lawyers are preparing in this regard. This is not a hearing where they will prosecute, instead they will be the ones to stand trial. This is a project designed by AKP and MHP, aiming to push HDP out of democratic politics. This is all organized."   CALL FOR THE OPPOSITION   Underlining that they are not pessimistic and that they will reverse the judgement, Beştaş said: "Together with the people, we will tell that this is a conspiracy, that it is a continuation of putschism and that this government harms this people. With all the dynamics of democracy, we can reverse this process, we believe in it. Despite all these hostile policies towards HDP, there is no loss of votes. They may have made their decision but the people will make the final decision.  Anyway, the main reason why they are doing all of these is to prevent the opposition to unite and fight back. We are calling on to the opposition and our people to follow the case. This is an open call. Come see the facts in that court room.
