Arrest of HDP MPs suggested with unsigned note sent to Kobané case prosecutor 2021-04-20 12:33:55 ANKARA - With the unsigned information note sent to the prosecutor in the Kobanê Case in 2018, it was recommended that there was no obstacle for the interrogation, detention and arrest of the 7 HDP MPs.   It was revealed that an information note was sent by the Anti-Terror Branch Office to the prosecutor of the file, regarding the Kobanê Case, which will be held on April 26. This information note dated 26 October 2018, which was sent to the prosecutor four years after the Kobanê investigations began in 2014, is unsigned.   In it's content, it was stated that an investigation law launched and that there was no legal obstacle for the interrogation, detention and arrest of HDP MPs Ayhan Bilgen, Garo Payan, Hüda Kaya, Meral Danış Beştaş, Saruhan Oluç, Serpil Kemalbay and Sezai Temelli.   REQUEST FOR THE ARRESTS OF THE MPS   The relevant section in the information note is as follows: “Among 98 suspects, Ayhan Bilgen, who was elected as a deputy in the 27th term, Karabet (Garo) Paylan, Hüda Kaya, Meral Danış Beştaş, Hakkı Saruhan Oluç, Serpil Kemalbay Pekgözegü and Sezai Temelli were investigated before the election within the scope of the file. In the case of 7 suspects mentioned in accordance with Article 14 of the Constitution, it was evaluated within the scope of the investigation that the guarantee of immunity to the legislature regulated in Article 83 of the Constitution would not be valid. For this reason, there is no legal obstacle for the interrogation, detention and arrest of these 7 suspects."   PREPERATIONS TO BAN THE PARTY STARTED BACK THEN   In the information note dated 2018, there are also statements about the closure of the HDP, against which the Supreme Court Chief Public Prosecutor Bekir Şahin filed a lawsuit in the Constitutional Court on March 17, 2021.
